The present essay addresses the conceptual structure of customary law, understood as a set of customary rules. More specifically, it deals with the core question of what opinio juris entails as a constituent element of customary law. The work will begin with an analysis of samples of common strategies in contemporary legal theory that deal with opinio juris when analyzing the structure of customary law. Subsequently, following Hart’s notion about what constitutes social rules, and introducing explanatory features from Game Theory (...) applied to social philosophy and some insights from Behavioral Economics, the goal of the present study is to propose a different conceptual path for analyzing and identifying customary law with what could be understood as “opinio juris”, given the conceptual necessity of finding the normative element that lies within the usus, or social practices. Die Revision des Wahrheitsbegriffs seitens Nietzsches kommt so ans Tageslicht. Forscher wie J. Simon und F. Kaulbach haben unterstrichen, daß Nietzsche die schon von Kant angelegte Übertragung der Wahrheit aus dem Theoretischen ins Praktische vollzogen hat. In seiner geplanten Doktorarbeit im Jahr 1868 Die Teologie seit Kant greift Nietzsche F.A. Langes und K. Fischers Auslegungen (...) auf, deren Einfluß auch in seinen späteren Werken noch wahrnehmbar ist. Insbesondere entnimmt er Kant die Gegenüberstellung von menschlicher und tierischer Welt, der dann seine offene Kritik am kantischen "Anthropomorphismus" folgt. Nietzsche nimmt so mit Kant Stellung.In the last decades, many Nietzsche scholars have begun to attend Kant's influence on Nietzsche's philosophy, particularly on his criticism of science and of knowledge. This is how Nietzsche's reexamination of the concept of truth emerges. Scholars such as J. Simon and F. Kaulbach have stressed how Nietzsche has completed the displacement of truth - already formulated by Kant - from the level of theoretical reflection to the level of pragmatical reflection. In the planned Doktorarbeit of 1868, Die Teleologie seit Kant, Neitzsche uses Kant interpretations of F. A. Lange and K. Fischer, whose influence can still be found in the works of the maturity. It is mainly from Kant that Nietzche derives the opposition between human world and animal world. Such an opposition turns into an open criticism of what he considers the Kantian anthropomorphism. With his talk of the ”death of God“, the philosopher Friedrich Nietzsche presented a diagnosis of the future that is both problematic and highly topical. Although this had been the subject of exhaustive discussion in connection with the resulting practical problem of the loss of values, its relevance for the status and selfunderstanding of the theoretical sciences has not been broached. 17 contributions from well-known scholars approach the subject by highlighting the connection between the specific nature of modern science and (...) the non-involvement of theology. This article offers an insight into Yoḥanan Alemanno’s study of the ‘art of thinking’ through his notes from Averroes’s commentaries on Posterior Analytics, De anima and Parva naturalia. This case study represents an important example of the 15th-century Jewish learning based on the Arabic-Hebrew philosophical tradition and shows the continuity between the Provençal world and the Italian Renaissance. The textual appendix included at the end of the article aims at showing how Alemanno selected portions of Averroes’s commentaries on logic and (...) psychology that define the role of the faculty of imagination and the processes through which we acquire true knowledge. In discussing the works of 16th-century theorists Francisco de Vitoria and Alberico Gentili, this article examines how two different conceptions of a global legal community affect the legal character of the international order and the obligatory force of international law. For Vitoria the legal bindingness of ius gentium necessarily presupposes an integrated character of the global commonwealth that leads him to as it were ascribe legal personality to the global community as a whole. But then its legal status and its (...) consequences have to be clarified. For Gentili on the other hand, sovereign states in their plurality are the pinnacle of the legal order(s). His model of a globally valid ius gentium then oscillates between being analogous to private law, depending on individual acceptance by states and being natural law, appearing in a certain sense as a form rather of morality than of law. This book compares the respective concepts of the law of nations put forward by the Spanish theologian Francisco Suárez and by the Dutch jurist Hugo Grotius. This comparison is based on the fact that both thinkers developed quite similar notions and were the first to depart from the Roman conception, which persisted throughout the entire Middle Ages and the early Renaissance. In Rome, jus gentium was a law that applied to foreigners within the Empire, and one which was often mistaken (...) for Natural Law itself. These two features can be found even in the works of writers such as Francisco de Vitória and Alberico Gentili. In Suárez and Grotius, the law of nations is applicable to an extra-national domain and inarguably becomes positive law. Yet, it also contains an ethical element that prevents it from transforming into a mere reflection of state interests. This work argues that this resemblance is hardly a coincidence: Grotius has read Suárez, and that influence has modified the foundations of his early thoughts on jus gentium. This should not be taken to imply that the Dutch jurist wasn't original: in both authors, the definition of the law of nations pursues his own internal logic. Nevertheless, Suárez's oeuvre allowed Grotius to solve a fundamental problem touched on in his early writings that had remained unanswered. Accordingly, his oeuvre promises to clarify one of the most significant moments in the History of International Law. (shrink)

The purpose of the present study is the understanding of Gentili's position on the law of the sea as expressed in his classic De iure belli . The key constitutive elements turn out to be: 1) the idea of the sea as 'res communis' to all mankind, which amounts to the concept of 'freedom of the sea'; 2) 'jurisdiction' of the coastal state on the adjacent sea, even on the high seas, in order to police crime and prevent/punish piracy. As (...) such these two key elements, if taken in isolation, are rooted in the civil law tradition, but their true meaning can only be captured by placing them in the intellectual framework of which they constitute an integral part. Firstly, the epistemic structure of discourse hinges on the new science of natural jurisprudence, as applied to the subject of 'ius gentium bellicum'; secondly, the constituent theoretical languages emanate from a distinctive combination of civil law, scholastic-theological and humanist traditions. This procedure enables us to highlight the strikingly original and distinctly modern traits of Gentili's perspective on the law of the sea, which emerges as a corollary of his project of international/global order. A project that is based on the crucial notion of 'respublica magna' of mankind, a notion encompassing the two notions of 'freedom' and 'jurisdiction' that constitute and define the legal regime of the sea.The Stoic humanist notion of universal human society as 'corpus unum' implies, first of all, 'freedom of intercourse', or 'ius communicationis', to start from 'free passage' and 'freedom of commerce'. It is in the context of his argument about these basic freedoms that Gentili is finally led to discuss the subject of the 'law of the sea'. But, not only the concept of 'res communis', or 'freedom of use', but also the concept of 'jurisdiction', or 'protection', are strictly related to the same foundational concept of 'respublica magna'. This is a crucial characteristic of Gentili's approach to world order that is proved by reference to two cardinal points of his new 'cosmopolitan justice': 1) the 'international right to punish', as exemplified by the legitimacy of the wars of 'humanitarian intervention' and of the wars in support of the 'common law of mankind'; 2) the 'occupation of vacant land', which again underlines the relevance of the principle of 'jurisdiction' by striking a balance between the principle of 'free use' of nature and the 'jurisdiction' of the local ruler.Such a reconstruction definitely rejects the traditional image of Gentili as a supporter of 'maritime protectionism', on the ground of his Advocatio Hispanica published posthumously in 1613 and containing his pleadings as Spanish advocate before the Court of Admiralty. The guiding assumption here is that the book is strictly of a forensic character and as such devoid of any coherent theoretical substance. To the contrary, in his De iure belli, far from anticipating the English position in favour of 'mare clausum', Gentili tends to anticipate the essentials of Grotius' position, especially at the level of the ethic of the 'modern cosmopolis' and the related theme of colonial empire. On this very plane of discourse, Gentili's thinking transcends the so-called battle of the books and emerges as especially significant in illuminating the wider and deeper intellectual currents that contributed to the development of what were to become basic standard positions of modern international theory. This book offers the first comprehensive account and re-appraisal of the formative phase of what is often termed the 'Grotian tradition' in international relations theory: the view that sovereign states are not free to act at will, but are akin to members of a society, bound by its norms. It examines the period from the later fifteenth to the mid-seventeenth centuries, focusing on four thinkers: Erasmus, Vitoria, Gentili and Grotius himself, and is structured by the author's concept of international society. (...) Erasmus' views on international relations have been entirely neglected, but underlying his work is a consistent image of international society. The theologian Francisco de Vitoria concerns himself with its normative principles, the lawyer Alberico Gentili - unexpectedly, the central figure in the narrative - with its extensive practical applications. Grotius, however, does not re-affirm the concept, but wavers at crucial points. This book suggests that the Grotian tradition is a misnomer. (shrink)

Nietzsche and the Long Flight of the “Good European”. The question of “the good European,” as Nietzsche conceives it, refers to a complex process of cultural transformation that starts from the critical relationship toward the European Christian heritage. Two topics, Science and History, have been studied for centuries, if not millennia, often in disjointed ways. No início deste ano, contemporânea a uma edição comemorativa dos quarenta anos deexistência do lnstitutus-Rainnmdus-Lullus em Freiburg i. Br., um tanto atrasada, mas nem por isso menos importante, apareceu a tradução alemã do Liber de gentili et tribus sapientibus,. Duas circunstâncias tornaram importante o aparecimento deste livro para todos os que se interessam por Ramon Llull e pela cultura catalã. Em primeiro lugar, por ser esta não somente a primeira edição completa desta obra em alemão, que substitui a edição selecionada, (...) muito fragmentária, de Xosé e Elisabeth Scheible1 mas, ao mesmo tempo, por ser a primeira tradução completa em língua alemã desta obra.2 Além disso, o fato de este livro aparecer numa tão conhecida editora como a de Philipp Reklam indica que o Buch vom Heiden und den drei Weisen será, pelo menos nos próximos anos, a obra de Llull pela qual os leitores alemães terão o primeiro contato com o fascinante pensamento do maiorquino. Esta obra, que representa uma importante contribuição para o discurso inter-religioso na Idade Média, presta-se verdadeiramente como introdução ao pensamento do Doctor muminatus e apresenta as características essenciais da análise combinatória de sua Ars, de forma altamente explícita e igualmente estética e literária. Constituem seu guia e base narrativa os diálogos de três sábios, representando as três grandes religiões, enquanto caminham por uma selva até a descoberta dum locua amoenus, magistralmente descrito, em meio do qual encontram cinco grandes árvores, em cujas folhas se acham gravadas as combinações binárias dos princípios básicos Julianos. Aqui os três sábios, e com eles o leitor, são conduzidos pela dama Inteligência, e com ajuda das árvores, na funcionalidade da análise combinatória Juliana, antes de exporem racionalmente aos desconfiados pagãos a confortadora verdade salvífica da respectiva fé de cada um. Com isso o tradutor e editor Theodor Pindl, que já se distinguiu com diversos trabalhos, especialmente sobre o Breviculum, satisfaz na sua versão, com poucas exceções,3 as qualidades tanto filosóficas como literárias da obra e produz um texto bastante legível. No entretanto, nao baseou sua tradução na edição crítica do texto catalão feita por Antoni Bonner,4 publicada em 1993 na série Nova edició de les obres de Ramon Llull, mas recorreu à edição latina de 1721, de Ivo Salzinger, reeditada em 1965. O que é de se admirar, pois a edição feita em Mainz por Ivo Sa!zinger, como é sabido, sofreu numerosas modificações no que diz respeito à ordem das frases e à escolha das palavras feitas pelo editor. A single, fairly simple proposition lies at the heart of the present contribution, viz. that the development of early-modern literature on international law should be regarded as a specific form of the early usus modernus during the second half of the sixteenth century and the first half of the seventeenth century.In Section 1 that general proposition and some of its ramifications will receive some further explanation. First, the main characteristics of usus modernus will be set out, and, subsequently, their applicability (...) to early-modern literature on international law will be outlined. In addition, the question should be raised, what purpose the characterisation of that literature as part of the more general usus modernus may serve. These considerations may inevitably appear somewhat abstract. Section 2 will therefore aim to provide a particular illustration, based on two contemporary works on the law of naval warfare, viz. A. ABSTRACT In the 11th century, the dialogical literature that emerged in the context of Latin Christianity included, among its repertoire of interlocutors, one that was always fictional: the Gentile. Thus, the question arises as to the purpose of entering into dialogue with an imaginary other. The article examines the constructions of identity of the first two known Gentile characters: that of Gilberto Crispino's Disputatio christiani cum gentili and that of Pseudo-Anselm's Disputatio inter christianum et gentilem. On the basis of these constructions, we discuss the role played by each Gentile in his respective dialogue, in order to establish the relationship between these participating identities and the intentio operis. Scholarly debates on the Critique of Pure Reason have largely been shaped by epistemological questions. Challenging this prevailing trend, Kant's Reform of Metaphysics is the first book-length study to interpret Kant's Critique in view of his efforts to turn Christian Wolff's highly influential metaphysics into a science. Karin de Boer situates Kant's pivotal work in the context of eighteenth-century German philosophy, traces the development of Kant's conception of critique, and offers fresh and in-depth analyses of key parts of the Critique (...) of Pure Reason, including the Transcendental Deduction, the Schematism Chapter, the Appendix to the Transcendental Analytic, and the Architectonic. The book not only brings out the coherence of Kant's project, but also reconstructs the outline of the 'system of pure reason' for which the Critique was to pave the way, but that never saw the light. On Carlos Moya's Reply to the Argument from Luck Resumen: Esta nota crítica se centra en el argumento de Carlos Moya a favor de la conclusión de que el Argumento de la Suerte representa en realidad un problema mayor para los compatibilistas que para los libertaristas. La Sección 1 introduce brevemente el Argumento de la Suerte. La Sección 2 discute la distinción de Moya entre dos concepciones de deliberación práctica, y propone una manera alternativa a la de Moya de entender (...) la crítica al libertarismo que se basa en la condición de que cualquier decisión libre debe tener una explicación contrastiva. Finalmente, la Sección 3 resume la respuesta libertarista de Moya al Argumento de la Suerte, y sugiere un modelo alternativo de determinismo que Moya podría considerar para completar su argumento. Premiere traduction francaise etablie sur l'edition critique du texte latin, cet ouvrage rend accessible a un plus large public la Summa de anima de Jean de la Rochelle qui revet un triple interet. Elle offre d'abord une presentation magistrale de l'enseignement portant sur l'ame dans les annees 1230-1235 a Paris. Elle permet de la sorte d'evaluer l'etat de la reflexion sur l'ame a l'oree de du travail de reinterpretation de l'aristotelisme tel que le vehiculait la tradition greco-arabe par Albert le (...) Grand et Thomas d'Aquin. Elle constitue enfin une tentative, emanant d'un des premiers maitres en theologie franciscains, d'integration de la philosophie greco-arabe (notamment celle d'Avicenne, qui rencontre ici le Pseudo-Augustin, Augustin, Jean Damascene et Philippe le Chancelier) a la reflexion theologique. Ce texte prepare ainsi les grandes syntheses des Sommes posterieures au premier rang desquelles figure evidemment la Summa fratris Alexandri qui incorpore, au livre II, des chapitres entiers. Pretendemos demonstrar com este trabalho como o pronome pessoal plural nós exerce um papel fundamental no pensamento de Nietzsche quanto à relação entre amizade e filosofia. O centro articulador dessa relação é a noção de que a amizade é um espaço de partilha de vivências (de com-vivência, portanto) pré-racional e, enquanto tal, um espaço de factibilidade da nova forma de filosofia proposta por Nietzsche, aquela que articula pensamento e vida. Para isso, pretende-se analisar o uso da suspeita como estratégia filosófica, (...) em que medida o nós pode ser entendido como uma crítica ao atomismo metafísico do eu e à necessidade da comunicação e, por fim, como essa nova forma de filosofia se efetiva como partilha da alegria. A amizade, assim, é vista como espaço privilegiado no qual a filosofia deixa de ser apenas uma forma de pensar para se tornar uma forma de viver. (shrink)

Byzance, menacée depuis deux siècles par les Ottomans, tombe en 1453, un an après la mort du philosophe Pléthon. Ce livre traite de la grandeur et du déclin de la civilisation byzantine qui a revêtu un triple visage en alliant culture grecque, organisation impériale de Rome et religion chrétienne. Il y est question des relations difficiles entre l'orthodoxie grecque et le catholicisme romain, ainsi que du néo-platonisme que Pléthon a diffusé dans la Florence des Médicis, participant ainsi à l'émergence de (...) l'humanisme européen. No texto começa-se por recordar a controvérsia em torno da existência da filosofia portuguesa que se sustenta consubstanciar-se na questão: "há ou não filosofias especificamente nacionais, a cada nação corresponde uma filosofia própria?". Para solucionar o problema, seria indispensável fixar de modo indiscutível as noções de filosofia e nação. Não se aceitando a intuição das essências, que daria de modo directo e imediato as referidas noções, e entendendo-se que conceitos verdadeiros só podem surgir fundados num sistema, tentou-se, apenas, formular definições (...) convencionais de filosofia e nação, para estabelecer relações inegáveis entre elas, o que poderia dar um contributo para a problemática das filosofias nacionais, na hipótese de tais definições serem exactas ou, pelo menos, terem encontrado defensores. Considerou-se filosofia uma concepção do mundo racional, e nação uma certa comunidade de homens ligados pela istória e, porventura, por uma linguagem própria. Se a cada nação correspondesse uma filosofia cair-se-ia no relativismo, que é insustentável. Se se perfilhasse o ponto de vista que a filosofia depende da linguagem, logo da nação, a resposta seria que a linguagem expressa o pensamento, não é o pensamento. Assevera-se que uma concepção racional do mundo é sempre universal e que uma certa comunidade é, a fortiori, particular. A relação entre filosofia e nação será pois a do universal com o particular. Não é lícito absorver a filosofia na nação, como se esta fosse o universal concreto, nem dissolver aquela num universal que, nessa altura, seria abstracto. O universal supera o particular, sem o destruir, estando numa relação dialéctica com ele. O universal é, assim, universalização do particular. Por consequência, a filosofia será nacional mas de um "nacional" que se saiba auto-ultrapassar. O momento nacional é somente um momento da filosofia, não a própria filosofia na sua universalidade. /// Le texte commence par rappeler la controverse autor de l'existence de la philosophie portugaise, dont on affirme qu'elle s'identifie avec la question "y a-t-il, ou non, des philosophies spécifiquement nationales? A chaque nation correspond une philosophie propre?". Pour apporter une solution à ce problème, il serait indispensable de fixer de façon indiscutable les notions de philosophies et de nation. Comme on n'accepte pas l'intuition des essences, qui fournirait de façon directe et immédiate les notions mentionnées et comme on pense que de vrais concepts ne peuveunt surgir que fondés en un système, on a seulement essayé de formuler des définitions conventionnelles de philosophie et de nation en vue d'établir des relations irrécusables entre elles, ce qui pourrait constituer un apport pour la problématique des philosophies nationales, dans l'hypothèse que de telles définitions sont exactes ou ont, pour le moins, rencontré des adeptes. On considère la philosophie comme une conception rationnelle du monde et la nation, une certainne communauté d'hommes liés par l'histoire et, en particulier, pour une langue propre. Si à chaque nation correspondait une philosophie, on tomberait dans le relativisme, ce qui est insoutenable. Si l'on partageait le point de vue d'après lequel la philosophie dépend du langage, par suite, de la nation, la réponse serait que le langage exprime la pensée, n'est pas la pensée. On assure qu'une conception rationnelle du monde est toujours universelle et qu'une communauté donnée est particulière. La relation entre philosophie et nation sera donc celle qui existe entre l'universel et le particulier. Il n'est pas licite d'absorber la philosophie dans la nation, comme si celle-ci était l'universel concret, ni dissoudre celle-là dans un universel qui alors serait abstrait. /// Is there or is there not a specifically national philosophy? To each nation is there a corresponding philosophy? To answer these questions, which are certainly pertinent to the controversy concerning the existence of a Portuguese philosophy, one should state clearly what can be meant by philosophy and nation. By eliminating the approach by which one imagines it possible to have immediate and direct intuitions of these notions and by considering that true concepts are those that can be founded within a system, an attempt has been made here to formulate conventional definitions of philosophy and of nation in the hope that these definitions could be conjugated and made more precise. The idea that there be at the same time a rational world and a particular rationality, belonging to a particular community of men bound together by a common history and language, has been judged illusory. If to every nation there were a corresponding philosophy, an unbearable relativism would prevail. If one were to maintain that philosophy depended on language, and thus a nation, then the response would be that while language expresses thought, language is not thought. It is not legitimate to assimilate philosophy to a nation, as if the latter were a concrete universal; in this sense, it would be simply abstract. The universal overcomes the particular without destroying it, for the relationship is dialectical in nature: the universal is thus the universalization of the particular. Therefore, philosophy in national if one considers national as that which is capable of overcoming itself; the national moment is only a moment of philosophy, and not philosophy as such in its universality. This paper focuses on the reception of Bertrand de Jouvenel’s Du Pouvoir in post-war America. I show how Jouvenel drew on a firmly established tradition of ‘aristocratic liberalism’ in French political thought, which in turn allowed him to develop a pessimistic outlook on modern Western political culture as inherently conducive to totalitarianism. This profound pessimism allowed Du Pouvoir, which fell relatively flat in France itself, to become a critical success in the Anglophone world. Jouvenel’s jeremiad resonated in particular with Cold (...) War warriors such as Friedrich Hayek. (shrink)
